Uninsured and Underinsured Motorist Coverage in Michigan

Automobile

Author: Richard Migala

Michigan requires every vehicle registered and operated in Michigan to have automobile insurance.  Three coverages are mandatory.  Bodily Injury Liability coverage; Personal Injury Protection (PIP); and Property Protection, are all mandatory. All other coverages are optional. Many people try to save money on premiums by refusing optional coverages.  The choice is yours but before you make a choice its best to know what the coverage is and look at your declaration page to know what it costs.  Armed with that information you can make a fully informed decision on purchasing that coverage.

I like to say that Uninsured and Underinsured motorist coverage in Michigan is the cheapest form of disability or life insurance that you can purchase.  Think about this. It is said that over twenty percent of the cars being driven in Michigan are uninsured.  This means that if you are hit and either seriously injured or killed in a car accident that is not your fault, you have a 20% chance of not being able to recover in a bodily injury claim against the at fault party.

Uninsured motorist coverage means your insurance company steps into the shoes of the at fault person and you can bring a claim to collect for your injuries up to the dollar limit of coverage that you elected.  Underinsured motorist coverage allows you to collect the difference between what the other party’s bodily injury limits coverage is and the dollar limits of your underinsured coverage, if your limits are higher.

I have represented thousands of people who have been seriously injured or killed in accidents that were not their fault.  Some of the other drivers were negligent, drunk, distracted or on drugs and were uninsured.  Fortunately, many of my clients elected to take out uninsured and underinsured motorist coverage and I was able to collect hundreds of thousands of dollars for those clients.  Unfortunately, many of my clients did not elect to take out that optional coverage and I was unable to collect anything for their horrific injuries.

You can sue an uninsured driver or owner of a vehicle and you might get a million-dollar jury award but its only a piece of paper to hang on the wall unless you can collect on it.  There is a reason why people drive uninsured, most have no money.I always recommend you take out this additional coverage.
